PROGRAM SUMMARY March-April 2024

            During the months of March and early April 2024, the CDCBAA hosted a four-part series of lectures delivered by prominent bankruptcy attorney, and former CDCBAA president and current board member, M. Jonathan Hayes.  The series was entitled: “NUTS AND BOLTS OF BANKRUPTCY APPEALS” and was presented as a webinar via Zoom.

            Mr. Hayes provided attendees with enlightened and frequently entertaining insight into the practice of handling appeals from the bankruptcy courts to the Bankruptcy Appellate Panels, the District Courts of California, and also to the Ninth Circuit. With his varied background that includes not only being a long-time bankruptcy law specialist with a significant and successful appellate practice, but also a bankruptcy law professor, mediator and former clerk to a BAP judge, Mr. Hayes has an especially unique understanding of the appellate process from many different perspectives.

            The lectures were well-organized and highly detailed. Mr. Hayes explained nearly everything needed for any attorney, new or seasoned, to handle an appeal, including filing deadlines, preparing the record on appeal, motions (both pre- and post- decision), opening and reply briefs, strategy, and oral argument.  He offered many personal tips on preparing effective briefs and also suggestions for organizing and presenting oral argument.

            Lengthy and detailed program outlines containing, inter alia, references to pertinent statutes and rules as well as sample filings were provided to all registered participants. Eligible participants also received California MCLE credit.

            The next CDCBAA members meeting and Zoom MCLE program will be held on April 20, 2024.  The topic will be “INTERSECTION OF TAXES AND BANKRUPTCY.”  Our speakers will be Najah Shariff | Assistant United States Attorney - Tax Division of United States Attorney's Office, Central District of California; and Steven Walker | Law Offices of Steven L. Walker.  Please Note: This CLE program will be held in person at the University of West Los Angeles Law School (Woodland Hills) and available as a WEBINAR via Zoom.
